This policy applies to Nikita Portuguese Restaurant & Motel ("Nikita's", "we", "us"), situated at Farm 493, Portion 136, Pelindaba Road, R512, Kalkheuwel, Broederstroom, North West, 0240. It covers our restaurant, motel, bar and games room, our events and markets, and our website at nikitasrestaurantandmotel.co.za.
For the purposes of the Protection of Personal Information Act 4 of 2013 ("POPIA"), we are the "responsible party" for the personal information described below. We respect your privacy and handle your information lawfully, fairly and transparently.

We collect only the information we reasonably need. Depending on how you deal with us, this may include:

We collect information directly from you (in person, by phone, WhatsApp, email, online forms or our booking calendar) and automatically through our website. We do not intentionally collect special personal information (such as health or religious information) unless you share it with us, for example an allergy or accessibility need, and then only to look after you. Because this website offers no online gambling, we do not collect any betting, wagering or gaming-account information through it.
How we use your information
- To take, confirm, change and manage restaurant, motel, event, conference and market-stand bookings.
- To communicate with you about your booking, visit or enquiry.
- To keep the financial and tax records we are required by law to keep for payments made in person.
- To keep our premises, guests, staff and gaming floor safe and compliant, including age checks.
- To run, secure and improve our website and services.
- To send you news, offers and event dates, but only where you have agreed or the law allows (see Marketing messages below).
- To comply with laws, regulations and requests from authorities.
We will not use your information for a purpose that is incompatible with the reason we collected it, unless the law allows it or you have agreed.
Why we may process your information
Under POPIA, we process personal information only when one of the lawful grounds applies. For us, these are usually:
- Your consent, for example when you submit a form, tick a consent box or ask us to contact you.
- Performing a contract, such as honouring a table, room, event or stand booking.
- A legal obligation, such as tax, accommodation and gambling-related record keeping.
- Our legitimate interests, such as security, preventing fraud and improving our services, where these do not override your rights.
If you gave consent, you may withdraw it at any time. This does not affect processing that already took place.
Who we share it with
We do not sell your personal information. We share it only where necessary and only with:
- Service providers who help us run the business, such as our website, booking, form and messaging platform (LeadConnector), the card-machine and payment providers we use for in-person payments, email and WhatsApp messaging services, and Google (maps and reviews).
- Professional advisers, such as accountants and legal advisers, where needed.
- Authorities, where we are required or permitted by law, for example by a court, the South African Revenue Service, the police or a gambling regulator.
Some of our service providers store or process information on servers outside South Africa. Where this happens, we take reasonable steps to make sure the provider is bound to protect your information to a standard comparable to POPIA.
Cookies & website data
Our website and embedded booking and form tools may use cookies and similar technologies to make the site work, remember your preferences and understand how the site is used. Where our forms show a cookie notice, you can accept or decline non-essential cookies there.
You can also block or delete cookies in your browser settings. Doing so may stop parts of the website, such as the booking calendar, from working properly.
Marketing messages
If you have agreed to hear from us, or have booked with us before and the law allows it, we may send you updates about market days, live music nights, specials and events by email or WhatsApp.
You can opt out at any time by replying "STOP", using the unsubscribe link in an email, or contacting us on the details below. We will still send you messages that are necessary for an existing booking.
Security & how long we keep it
We use reasonable technical and organisational measures to protect your information against loss, damage, unauthorised access or misuse. These include access controls on our systems, secure platforms for bookings and forms, and limiting who on our team can see your details.
No system is completely secure. If we become aware that your personal information has been accessed or acquired by an unauthorised person, we will notify you and the Information Regulator as required by POPIA.
We keep your information only for as long as we need it for the purpose it was collected, or as the law requires. For example, financial records are generally kept for several years to meet tax requirements, while enquiries and marketing details are kept until you ask us to remove them or they are no longer needed. When we no longer need information, we delete or de-identify it.
Your rights
Under POPIA, you have the right to:
- Ask whether we hold personal information about you, and request a copy.
- Ask us to correct or update information that is inaccurate or incomplete.
- Ask us to delete or destroy information we are no longer allowed to keep.
- Object to us processing your information, including for direct marketing.
- Withdraw your consent where we rely on it.
- Lodge a complaint with the Information Regulator if you believe we have not handled your information properly.
To use any of these rights, contact us using the details below. We may need to confirm your identity first, and we will respond within a reasonable time. The Information Regulator (South Africa) can be reached at inforegulator.org.za.
Children
Our restaurant, market and many events are family friendly, but our website and bookings are intended for adults. We do not knowingly collect a child's personal information without the consent of a parent or guardian. Our games room is strictly for persons 18 years and older.
Changes & third-party links
We may update this policy from time to time. The "last updated" date at the top of this page shows when it last changed. If we make important changes, we will make this clear on our website.
Our website may link to other sites, such as Google Maps, Facebook, Instagram and WhatsApp. We are not responsible for the privacy practices of those sites, so please read their policies.
