About these terms
These Terms & Conditions apply to your use of the services offered by Nikita Portuguese Restaurant & Motel ("Nikita's", "we", "us") at Farm 493, Portion 136, Pelindaba Road, R512, Kalkheuwel, Broederstroom, North West, 0240, and to our website at nikitasrestaurantandmotel.co.za. This includes our restaurant, bar, beer garden, motel rooms, games room, stage and conference venues, events and markets.
By visiting us, making a booking, or using our website, you agree to these terms. If you do not agree, please do not use our services. Nothing in these terms is intended to limit any right you have under the Consumer Protection Act 68 of 2008 or other South African law.
Restaurant & bar
- Walk-ins are welcome. Table reservations are recommended, especially on weekends, event nights and for larger groups.
- Reservations are subject to availability. Please tell us as early as possible if you need to change or cancel, or if you will be late. We may release a table if a guest is substantially late without contacting us.
- Special requests (such as birthdays or seating preferences) are noted and we will do our best, but they cannot be guaranteed.
- Please tell your server about any food allergies or dietary needs. We take allergies seriously but cannot guarantee that any dish is completely free of allergens.
- Menu items, prices and opening hours may change. Our current hours are shown on our website and in our venue.
Motel accommodation
- A booking is confirmed once we have accepted it through our booking calendar, by phone, WhatsApp or email. Please check your confirmation details carefully.
- Rooms are for the number of guests booked. Extra guests may only stay with our prior agreement and may be charged for.
- Please contact us as early as possible to change or cancel a booking. Any deposit, cancellation or no-show terms that apply will be confirmed to you at the time of booking.
- We may ask for identification at check-in, as required by law and for the safety of our guests.
- You are responsible for any loss or damage to the room, furnishings or property caused by you or your visitors, beyond fair wear and tear.
- Please keep noise reasonable, particularly at night, out of respect for other guests.
Games room (18+)
- Only persons aged 18 and over may enter the gaming area or play any gaming machine, in line with the National Gambling Act 7 of 2004 and applicable provincial gambling laws.
- We may ask for valid proof of age at any time and may refuse entry or ask you to leave if you cannot provide it.
- We reserve the right to refuse entry to, or remove, anyone who appears intoxicated, behaves inappropriately, or whom we reasonably believe may be a problem gambler.
- All play is subject to the rules displayed on or near each machine. Where a machine malfunctions, any resulting play, credits or payouts may be voided.
- Gambling can be addictive. Only play with money you can afford to lose and set limits before you start. If gambling is affecting you or someone you know, free help is available from the National Responsible Gambling Programme: call 0800 006 008 (toll-free) or SMS 076 675 0710.
- If you would like to be excluded from our gaming area, please speak to a member of staff.
Alcohol
- Alcohol is only sold to persons aged 18 and over. We may ask for identification and may refuse a sale if we are not satisfied.
- We reserve the right to refuse service to anyone who appears intoxicated.
- Please do not drink and drive. If you have been drinking, we are happy to help arrange a safe way home, or you are welcome to book a room.
- Alcohol may not be brought on to the premises for consumption without our permission.
Events, markets & stands
Events and live nights. Dates, line-ups and ticket or entry arrangements may change. Where an event is ticketed, the terms shown at the time of purchase apply.
Market days. Our markets are not held every week. Dates are announced on our website and social media pages and may change or be cancelled, for example because of weather.
Market stand bookings. A stand booking is confirmed only once we have accepted it. Stand holders:
- are responsible for holding any licences, permits and insurance required to trade, and for complying with food-safety and consumer laws for the goods they sell;
- must keep to the stand space allocated and leave it clean and undamaged;
- trade at their own risk, and we are not responsible for their stock, equipment or takings; and
- may be asked to pack up if they breach these terms or our reasonable instructions.
Private functions and conferences. Prices, deposits, cancellation terms and inclusions will be agreed with you in writing before the booking is confirmed.
Prices & payment
- All prices are in South African Rand (ZAR). Current room rates are shown on our booking page and may change from time to time. The rate confirmed to you at booking is the rate that applies to that booking.
- We will tell you at the time of booking how and when payment must be made. Accepted payment methods may differ by service.
- We make every effort to display correct prices. If we discover a pricing error, we will contact you and give you the option to proceed at the correct price or cancel without penalty.
Conduct & safety
- Please treat staff, guests and vendors with respect. Abusive, threatening, violent or discriminatory behaviour is not tolerated.
- Illegal activity, including the use or possession of illegal drugs, is not permitted on the premises.
- Children must be supervised by a responsible adult at all times, including around the beer garden, boma and any water or fire features. Children are not allowed in the gaming area.
- We may ask anyone who breaches these terms or endangers others to leave, without refund where the law allows.
- For safety, CCTV may be in operation in and around our premises.
Liability
We take reasonable care of our guests and their property. However, to the fullest extent permitted by law, including the Consumer Protection Act, we are not liable for:
- loss of, theft of, or damage to personal belongings or vehicles on our premises, which remain your responsibility;
- injury, loss or damage that does not result from our negligence or breach of these terms; or
- indirect or consequential loss.
Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited.
Unforeseen events
We are not responsible for delays, changes or cancellations caused by events beyond our reasonable control, such as severe weather, power or water outages, load shedding, fire, public health measures, civil unrest or supplier failure. Where this affects a confirmed booking, we will contact you and work with you to reschedule or find a fair solution.
